Dismissal Solution Obtained Despite an Unfavourable Forensic Toxicology Report

We obtained a dismissal solution in a criminal case concerning driving under the influence of psychoactive substances, in a context where forensic toxicology practice still raises serious methodological difficulties.

Although Decision no. 25/2025 of Romania's High Court clarified that criminal liability requires proof of actual influence, we continue to see expert reports drafted in generic terms without scientifically robust explanation.

Through targeted objections, toxicology-based argumentation and a request for supplementation of the expert report, we demonstrated that the legal elements of the offense were not met. The prosecution dismissed the case accordingly.
