We obtained an important solution for a client in a particularly delicate legal context: prosecution for driving under the influence of psychoactive substances while already under a suspended sentence in a separate drug-trafficking matter.
Based on international toxicology references, we argued that the amphetamine level identified in blood fell within the therapeutic range and below thresholds typically associated with impaired driving ability. The court retained that motor functions and reflexes were not significantly affected and applied a criminal fine.
The court also considered the client's genuine rehabilitation path, and ultimately avoided imprisonment and did not revoke the prior suspension. The judgment remained final.
